Please read these Terms of Service ("Terms") carefully before using Aviquill ("the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Aviquill.
These Terms form a legally binding agreement between you and Aviquill. We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
You must be at least 13 years old to use Aviquill. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.
You agree not to use the Service to:
You retain ownership of all content you create in Aviquill. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, display, and transmit your content solely to operate and improve the Service.
You are solely responsible for your content. We do not review user content proactively, but we reserve the right to remove content that violates these Terms or applicable law.
When you share a canvas with other users, those users can view and (depending on permissions) edit the canvas. You are responsible for who you share your canvases with. Revoke access at any time from the canvas settings.
All rights in the Aviquill platform, brand, interface, and code are owned by or licensed to us. Nothing in these Terms grants you a right to use our trademarks, logos, or other proprietary material without our prior written consent.
We strive to keep Aviquill available at all times, but we cannot guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice where possible.
To the maximum extent permitted by law, Aviquill is provided without warranty of any kind — express or implied — including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.
To the fullest extent permitted by applicable law, Aviquill and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising out of or in connection with your use of the Service — even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) £50 GBP.
You may stop using the Service and delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
